Terms of Service

1. Agreement to Terms

Welcome to xrp3d.ai (the "Service"), a product of 3Dimensions.studio, operated by TokenCanvasIO, a company operating in Guernsey, Channel Islands ("Company," "we," "us," or "our"). By accessing or using our Service, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

2. Service Description

xrp3d.ai provides an AI-powered platform that:

• Converts user-uploaded 2D images into 3D models using advanced AI technology
• Generates high-quality 3D assets in GLB format
• Offers three service tiers: File Only, NFT+IPFS, and NFT+Arweave
• Mints 3D models as Non-Fungible Tokens (NFTs) on the XRP Ledger (NFT tiers only)
• Stores 3D models on IPFS via Pinata or Arweave blockchain (NFT tiers only)
• Delivers NFTs directly to user-specified XRP wallet addresses (NFT tiers only)

3. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account and Wallet Requirements

4.1 Wallet Connection (NFT Tiers Only)

To use NFT+IPFS or NFT+Arweave tiers, you must connect a compatible XRP Ledger wallet (such as Xaman). You are solely responsible for:

• Maintaining the security of your wallet credentials
• All transactions conducted through your wallet
• The accuracy of the wallet address you provide for NFT delivery

4.2 Wallet Security

We will never ask for your private keys or seed phrases. Never share these with anyone claiming to represent xrp3d.ai.

4.3 File Only Tier

File Only tier does not require an XRP wallet. Payment is processed via MoonPay and the GLB file is available for immediate download.

5. Payment Terms

5.1 Pricing

Current service pricing:

• File Only: $7.49 USD per conversion (card payment via MoonPay)
• NFT+IPFS: $7.49 USD worth of XRP per conversion (XRP payment via Xaman)
• NFT+Arweave: $9.99 USD worth of XRP per conversion (XRP payment via Xaman)

Prices are subject to change with 30 days' notice posted on our website.

5.2 Payment Processing

• Card Payments (File Only): Processed through MoonPay, our third-party payment processor
• XRP Payments (NFT Tiers): Processed directly on the XRP Ledger and are irreversible

5.3 Service Tier Details

File Only Tier ($7.49 USD)

• Download GLB file immediately after generation
• No NFT certificate
• No blockchain storage
• File available for re-download for 30 days via My Models page
• Full commercial rights

NFT+IPFS Tier ($7.49 USD in XRP)

• Download GLB file immediately after generation
• NFT certificate minted on XRP Ledger
• 3D model stored on IPFS via Pinata
• Accessible via IPFS CID in NFT metadata
• Fast, decentralized storage
• Full commercial rights

NFT+Arweave Tier ($9.99 USD in XRP)

• Download GLB file immediately after generation
• NFT certificate minted on XRP Ledger
• 3D model stored on Arweave blockchain
• Accessible via Arweave TX ID in NFT metadata
• Permanent storage guaranteed for 200+ years
• Cannot be deleted or censored
• Full commercial rights

5.4 No Refund Policy

5.5 Cryptocurrency Transaction Risks (NFT Tiers)

You acknowledge and accept that:

• Cryptocurrency transactions are irreversible
• You are responsible for network fees (gas fees)
• We are not liable for losses due to network congestion, incorrect addresses, or price volatility
• XRP prices may fluctuate between payment initiation and transaction completion

5.6 Storage Disclaimers

IPFS via Pinata (NFT+IPFS Tier):

• Files remain accessible as long as Pinata continues operations
• We are not liable for Pinata service interruptions or discontinuation
• You can re-pin content to other IPFS providers using the CID

Arweave (NFT+Arweave Tier):

• Storage is permanent and guaranteed by Arweave's economic model
• We are not liable for Arweave network failures (though statistically improbable)
• Content cannot be deleted once stored

6. User Content

6.1 Content Ownership

You retain all ownership rights to your original 2D images ("User Content"). By uploading User Content, you represent and warrant that:

• You own all rights to the content or have obtained all necessary permissions
• Your content does not infringe any third-party intellectual property rights
• You have the right to grant the licenses described in these Terms

6.2 License Grant to Us

By uploading User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

• Process and convert your 2D image into a 3D model
• Store your content temporarily for service delivery
• Upload to IPFS or Arweave for storage (NFT tiers only)
• Use anonymized, non-identifiable examples for marketing purposes (only with your explicit consent)

This license terminates when we delete your User Content from our systems (typically 30 days after service completion for File Only tier).

6.3 Generated Model Ownership

Upon successful payment and service completion, you own the Generated 3D Model and associated NFT (if applicable), subject to these Terms.

7. Prohibited Content

7.1 Content Restrictions

You must not upload User Content that:

• Is illegal or promotes illegal activities
• Contains nudity, pornography, or sexually explicit material
• Depicts or promotes violence, hate speech, or discrimination
• Infringes copyright, trademark, or other intellectual property rights
• Violates privacy or publicity rights of any person
• Contains malware, viruses, or harmful code
• Depicts minors in any inappropriate context
• Violates any applicable laws or regulations

7.2 Content Review

We reserve the right (but have no obligation) to:

• Review any User Content before or after processing
• Use automated systems to detect prohibited content
• Refuse service for any content we deem inappropriate

7.3 Enforcement and Forfeiture

8. Service Availability and Quality

8.1 No Guarantees

The Service is provided "AS IS" and "AS AVAILABLE." We do not guarantee:

• Uninterrupted or error-free service
• Specific quality outcomes for Generated Models
• Compatibility with all file formats or image types
• Specific generation times (though typical processing is 2-5 minutes)

8.2 AI Technology Limitations

Our AI model has inherent limitations when processing certain types of images:

• Highly reflective surfaces (watches, jewelry, polished metal, chrome) may produce distorted results due to how the AI interprets reflections as geometry
• Transparent or translucent materials (glass, crystal, clear plastic) confuse the AI's depth perception
• Complex reflections are interpreted as part of the object's surface rather than environmental reflections
• Fine details on reflective objects may appear blurred or merged together
• Matte, well-lit subjects with simple shapes typically produce the best results

You acknowledge these limitations and accept that results may vary significantly based on subject matter, lighting conditions, and image quality.

8.3 Generation Failures

If generation fails due to technical issues on our end (not content violations), we will offer a free retry or refund at our discretion.

8.4 File Size and Format

• Maximum upload size: 10 MB
• Accepted formats: PNG, JPG, JPEG, WEBP
• Generated format: GLB (3D model file)

9. NFT and Blockchain Terms (NFT Tiers Only)

9.1 NFT Characteristics

The NFTs minted through our NFT+IPFS and NFT+Arweave tiers:

• Are permanently recorded on the XRP Ledger
• Cannot be modified, deleted, or reversed once minted
• Are delivered to the wallet address you specify
• May have value determined solely by market forces
• Include metadata pointing to IPFS CID or Arweave TX ID

9.2 No Investment Advice

We make no representations about the value, marketability, or investment potential of NFTs. NFTs should not be considered investments or securities.

9.3 Blockchain Risks

You acknowledge risks including:

• Network forks or protocol changes
• Wallet hacks or loss of access
• Smart contract vulnerabilities
• Regulatory uncertainty
• Market volatility

9.4 Storage Layer Acknowledgment

You acknowledge that:

• NFT metadata points to off-chain storage (IPFS or Arweave)
• The 3D model file itself is not stored directly on XRP Ledger
• The NFT serves as a certificate of ownership pointing to the storage location

10. Intellectual Property

10.1 Our IP

We own all rights to:

• The xrp3d.ai website, branding, and logos
• Our proprietary technology and algorithms
• Service documentation and content

10.2 Third-Party Technology

Our Service uses third-party AI generation technology (Hyper3D), IPFS infrastructure (Pinata), and Arweave blockchain. Their terms and conditions may also apply to generated content.

10.3 Copyright Infringement

If you believe content on our Service infringes your copyright, contact us at support@xrp3d.ai with:

• Description of the copyrighted work
• Location of the infringing content
• Your contact information
• Statement of good faith belief
• Statement under penalty of perjury of accuracy

11. Limitation of Liability

12. Indemnification

You agree to indemnify, defend, and hold harmless xrp3d.ai, TokenCanvasIO, 3Dimensions.studio, and their officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights
• Your use or misuse of the Service

13. Termination

13.1 By You

You may stop using the Service at any time. Outstanding payments remain due.

13.2 By Us

We may suspend or terminate your access immediately if you:

• Violate these Terms
• Engage in fraudulent activity
• Upload prohibited content repeatedly
• Abuse or attempt to manipulate the Service

13.3 Effect of Termination

Upon termination:

• Your right to use the Service ends immediately
• No refunds will be issued
• NFTs already minted remain on the blockchain (cannot be revoked)
• Sections that should survive (payment obligations, indemnification, limitation of liability) remain in effect

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Guernsey, Channel Islands, without regard to its conflict of law principles. The courts of Guernsey shall have exclusive jurisdiction over any disputes arising from these Terms.

14.2 Arbitration

Any disputes shall be resolved through binding arbitration in accordance with the rules of the Guernsey International Dispute Resolution Centre, except for:

• Intellectual property disputes
• Claims for injunctive relief

14.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions or representative proceedings.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice by:

• Updating the "Last Updated" date
• Posting a notice on our website
• Sending an email to registered users (if applicable)

Continued use of the Service after changes constitutes acceptance of the new Terms.

16. Miscellaneous

16.1 Entire Agreement

These Terms constitute the entire agreement between you and TokenCanvasIO regarding the Service.

16.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

16.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

16.4 Assignment

You may not assign these Terms. We may assign our rights and obligations to any successor or affiliate.
